1. ACCEPTANCE OF TERMS
By submitting an inquiry, quotation request, or purchase order to China Used Car Export (“we,” “us,” or “the Company”), you (“Buyer”) agree to be bound by these Terms of Service. These terms govern all transactions involving the export of certified used vehicles from China, including but not limited to pricing, inspection, documentation, shipping, and after-sales support.
2. ELIGIBILITY & REPRESENTATION
You confirm that you are:
- A legally registered business entity (dealer, distributor, fleet operator, government agency, or corporate buyer);
- Authorized to import motor vehicles in your jurisdiction;
- Responsible for verifying local import regulations, taxes, duties, and homologation requirements.
We do not sell to end consumers or unverified individuals.
3. VEHICLE SPECIFICATIONS & AVAILABILITY
- All vehicles are certified used, sourced directly from authorized Chinese channels.
- Inventory is subject to prior sale. We reserve the right to substitute a comparable model if the original becomes unavailable, with Buyer’s written consent.
- Vehicle condition, mileage, and specifications are based on our 30-point pre-shipment inspection report, which serves as the definitive condition record at time of export.
4. PRICING & PAYMENT
- Prices quoted are FOB (Free On Board) at designated Chinese ports (Shanghai, Guangzhou, Tianjin) unless otherwise stated.
- Payment terms: 30% deposit upon order confirmation, 70% before shipment, via irrevocable T/T or LC.
- All prices are exclusive of destination import duties, taxes, insurance, and inland transport.
- Currency: USD only.
5. INSPECTION & TRANSPARENCY
- Every vehicle undergoes a standardized inspection covering mechanical, electrical, structural, and cosmetic integrity.
- Full digital inspection reports (photos, odometer, diagnostics) are provided before payment finalization.
- Buyer may appoint a third-party inspector at their cost, with 48-hour advance notice. We will facilitate access.
6. EXPORT DOCUMENTATION
We provide the following export-compliant documents:
- Commercial Invoice
- Packing List
- Bill of Lading (or Air Waybill)
- Certificate of Origin
- MOFCOM Used Vehicle Export License
- Conformity Certificate (aligned with destination standards, e.g., GCC, SONCAP, INMETRO)
All documents are issued in English and digitally signed. Delays due to force majeure or regulatory changes are not our liability.
7. SHIPPING & LOGISTICS
- Shipping is coordinated through our approved freight partners. Transit times are estimates only.
- Risk of loss or damage transfers to Buyer upon onboarding at port of loading (per Incoterms® 2020 FOB).
- Insurance is not included unless explicitly quoted. We strongly recommend marine cargo insurance.
8. NO BROKER POLICY
We operate directly no brokers, agents, or intermediaries. Any representation by third parties is unauthorized. All communications must originate from sales@used-china.com or verified company representatives.
9. AFTER-SALES SUPPORT
Post-delivery, we provide:
- Technical documentation assistance
- Parts sourcing guidance (where available)
- Liaison with local service networks (non-warranty)
Note: We do not offer manufacturer warranties on used vehicles. All sales are final, “as-is, where-is” at port of loading.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, China Used Car Export shall not be liable for:
- Indirect, incidental, or consequential damages
- Delays caused by customs, port authorities, or force majeure (e.g., war, strikes, pandemics)
- Buyer’s failure to comply with local import laws
Our total liability per transaction is capped at the total amount paid by Buyer.
11. GOVERNING LAW & DISPUTES
These Terms are governed by the laws of the People’s Republic of China. Any dispute shall be resolved through arbitration in Shanghai under the rules of the China International Economic and Trade Arbitration Commission (CIETAC). The arbitration award is final and binding.
